The Cowessess First Nation wrote to the Indian Claims Commission in March 1996, requesting an inquiry into its rejected 1907 surrender claim. The following August, the Commission provided notice that it would conduct an inquiry into the matter. By subsequent agreement of the parties and the Commission, the inquiry was split in two phases; Phase I is reported in (2001) 14 Indian Claims Commission Proceedings 223. In March 2002, the Minister of Indian Affairs rejected the Commission’s recommendation, and, in October 2002, the Cowessess First Nation requested that the Commission proceed with Phase II. A review of the facts of this claim, together with our legal analysis, findings, and recommendations to the parties, is set out in the attached report.
