5203 |aThe Cumberland House Cree Nation (CHCN) submitted a specific claim regarding the unlawful taking of 22,080 acres of IR 100A by surrender. While the Commission agreed to conduct an inquiry into this claim, it also issued an interim ruling into this inquiry and the James Smith Cree Nation: IR 100A inquiry, whereas the Commission would conduct a single fact-finding process with respect to the history of IR 100A. The Commission held six planning conferences; a community session where it heard evidence from Chief Settee and eight elders; issued two interim rulings; and heard oral arguments from counsel for the parties. A review of the facts of this claim, together with our legal analysis, findings and recommendation to the parties, is set out in the report.
