"The refugee protection system within Canada must balance a number of factors. The law must embody the essence of the Convention Relating to the Status of Refugees (Refugee Convention) and its Protocol. This requires signatories not to return people in any manner whatsoever to the frontiers of territories where their lives or freedom would be threatened on account of their race, religion, nationality, membership in a particular social group or political opinion. The law must also reflect Canada’s obligation under the Convention Against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment. Of crucial importance is the Canadian Charter of Rights and Freedoms. As mentioned, the Supreme Court of Canada ruled in 1985 that the Charter protected refugee claimants, and since that time there have been a number of important decisions affecting both the substance and procedures of refugee and protection law"--Background.
