“In Canada, there is no doubt that the rights and freedoms guaranteed by the Charter are available to Aboriginal individuals as against the federal, provincial and territorial governments. However, there is virtually no case law on the application of the Charter to Aboriginal governments. The matter therefore has to be approached as one of first impression by examining relevant constitutional principles and statutory provisions, and attempting to construct rational and coherent legal doctrine"--p. 2-3.
