Because of the legacy of the Indian Act, elected council style governments in First Nations communities wield extensive authority delegated by the Minister of Indian and Northern Affairs. First Nations’ chiefs and councillors acting under the direction of the Minister of Indian Affairs, regulate such vital matters as housing, employment, membership and education. The structure of First Nations’ government established by the Indian Act entails a primary line of accountability and responsibility to the Minister of Indian Affairs, rather than to the people directly. With the significant fiscal responsibility which has come from new block funding arrangements with bands and tribal councils, the need to create and institute mechanisms which provide checks and balances upon the authority of government and foster accountability to First Nations’ citizens is crucial"--Intro., p. 4.</marc:subfield>
