"This paper is intended to provide an overview of the aboriginal and treaty rights framework underlying the Fraser River sockeye salmon fishery. It is primarily based on a survey of cases determined by the Supreme Court of Canada (the “Court”) the British Columbia Court of Appeal (the “BCCA”) and the British Columbia Supreme Court (the “BCSC”). This paper is not intended to provide an exhaustive discussion of all cases that may be relevant to aboriginal and treaty rights related to the fishery."--p. 3.
