"A recording or mechanical reproduction right was provided to the owners of copyright in musical works in Canada in the Copyright Act of 1921. The exercise of the right was, however, controlled by the incorporation of a system of compulsory licensing. This system remains in place today and has formed the basis upon which the functioning and growth of the recording industry in Canada has taken place. In essence, the compulsory license provisions of the Act state that once a mechanical reproduction of a musical work has been made, anyone else can also make a recording of that work, subject to meeting the requirements of the Act. This paper examines the different facets of the present compulsory licensing system and offers recommendations for its improvement"--Introduction.
