Bona fide occupational requirements and bona fide justifications under the Canadian Human Rights Act : the implications of Meiorin and Grismer: HR21-53/2007
This report provides an overview of two Supreme Court of Canada decisions that affect the interpretation of bona fide requirements and how these decisions have influenced the Canadian Human Rights Commission’s investigation process. The Commission will apply its modified approach whether the alleged discrimination took place before or after the decisions. The Commission prepared this report to help employers and service providers develop and put in place non-discriminatory standards and practices.
